What is an “Akte de command”?

An “akte de command” is a notarial deed that records that the bidder purchased on behalf of someone else during the auction. The person bidding acts as the apparent buyer, while the ultimate buyer, the “command”, is officially designated later.

This structure is used when the ultimate buyer does not want to or cannot bid in their own name. The possibility of using an akte de command must be stated in the auction conditions; not every auction allows this.

After awarding, the ultimate buyer must be reported to the notary within the specified period. Legally and fiscally, the purchase counts as one transaction, so transfer tax is levied only once.

Please note: in many cases, the original bidder remains jointly and severally liable for all obligations arising from the bid, even if another buyer is designated afterwards.
